Compliance Support

The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) evaluates the compliance of federal contractors by conducting Compliance Reviews of their Affirmative Action Plans (AAPs).

Our AAPs and reports are a roadmap to your potential problem areas with the federal government.  We are ready to examine indicators or advise you on how to pursue your own internal investigation.

We have intimate knowledge of the regulations and are able to tell you when the OFCCP Compliance Officer is “crossing the line” and making unreasonable demands.  Our suggestions result in the narrowing of data requests and a limitation of your potential exposure.

The style and organization of our Affirmative Action Plans facilitate OFCCP Compliance Reviews.  We are available to assist in the submission of AAPs and support data and throughout the entire Compliance Review process.  We are most effective as behind-the-scenes advisors during the audit process.  Many contractors, who have not had us prepare their AAPs, seek our assistance in reviewing their material before submitting it to the government.

We thoroughly review the material that must be sent to the government, including the compensation data the agency began requesting at the beginning of 2000.  We identify your potential exposure areas and give advice on how to rebut the appearance of a problem.  We advise our clients of issues that OFCCP Compliance Officers are likely to check on such as accessibility notices on websites used for recruiting and required job opening listings required by the veterans’ regulations.

Our intimate knowledge of the regulations enables us to identify instances when the Compliance Officers are overreaching their authority during the audit process.  We also utilize this knowledge to assist you in negotiating remedies that eliminate or limit liability and minimize reporting.

In addition to providing support for OFCCP compliance, we frequently assist in compliance with state and local Affirmative Action requirements.
