OFCCP Files Suit Against AmeriQual Alleging Hiring Discrimination Against Men

By | December 9, 2015

On December 9, 2015, the Office of Federal Contract Compliance Programs (OFCCP) announced that a lawsuit had been filed against AmeriQual Group, LLC alleging hiring discrimination against men. The OFCCP is alleging that AmeriQual steered men into loader and utility positions where there was less hiring than in the table inspector positions where women were placed. AmeriQual manufactures portable meals for the Department of Defense and other government agencies. The news release can be found at: http://www.dol.gov/opa/media/press/ofccp/OFCCP20152233.htm.

The OFCCP alleged that AmeriQual disproportionately selected women over men, despite there being a larger number of men in the applicant pool. The OFCCP is also alleging that AmeriQual attempted to create after-the-fact justifications for failing to hire male applicants by making notations and adding them to files where they did not originally appear on what was provided at the start of the investigation. AmeriQual also failed to provide certain hiring records during the course of the investigation. The OFCCP is continuing to focus on hiring and job placement to find evidence of steering and discrimination.
