On June 17, 2015, the Office of Federal Contract Compliance Programs (OFCCP) announced a lawsuit filed against WMS Solutions LLC, a staffing agency that hired construction laborers. The news release can be found at: http://www.dol.gov/opa/media/press/ofccp/OFCCP20151176.htm.
The OFCCP is alleging that WMS Solutions discriminated against non-Hispanic applicants, paid female workers less per hour, and gave less work hours to African American, Caucasian, and female laborers. The suit also alleges that the company knowingly allowed abusive practices by supervisors at their work sites, which included harassment and physical and verbal abuse. The supervisors allegedly intimidated Hispanic laborers by showing them videos of detained and deported Hispanic workers. Previously, in 2013, an Administrative Law Judge ruled against the OFCCP in the case against VF Jeanswear, citing the fact that “non-Asian” is neither a race nor an ethnic group.
